Publish, promote, or market your Brand (identity)

Before you publish, promote, or market your Brand (identity), You need to know or have an idea of what constitutes a proven case, if ever faced with infringement or defamation. Knowing what constitutes "admissible evidence", when protecting your creations, in addition to, proving a case (making sure sure you can avoid your solid, credible, truthful evidence from being dismissed as "hearsay" with credible expert testimony, and witnesses)..... is key.

Class action suits are an option. Maybe.Maybe Not. Sometimes you have to go after corporations, employees, and individuals for their contributions.

An ex-girlfriend published false information about her boyfriend's company, which was indexed by search engines.

Industry bulletin board posts from a former customer claimed that our client was running a "scam" operation.

A consumer protection "review" site seemed to always return extremely negative and detailed reviews of any company not advertising on the site.

An unhappy customer launched an extensive website critical of our client, including false and misleading claims and altered documents.

A nationally recognized speaker was defamed on a series of "review sites" surreptitiously run and controlled by competitors and indexed high on the major search engines.

A prominent University professor was told of a site with his name and photograph falsely claiming the he was a convicted pedophile.

Competing companies started posting links to state consumer affairs offices trying to get an investigation undertaken of our client.

Dissatisfied customers of our client decide to publish defamatory statements that quickly show up on the first page of organic Google results.


Our client's business was initially referred to by a popular blogger as a "scam", an inaccurate description requiring immediate attention since the results were showing up at the top of Google's results.


A business was told it would have to pay a very significant amount of money for a defamatory posting to be removed from a rip off reporting site.

A fast growing web company had a disgruntled employee go directly to several federal agencies, potentially resulting in the initiation of an investigation.

An internet company was sued for a declaratory judgment on the West Coast resulting from our client's complaints about defamatory posts and threats of legal action before we were hired.

The major business bureau issued a fraud warning on our client, threatening the existence of its business, without having conducted adequate due diligence and appropriate analysis to fully understand the nature of the business.


An unknown party was posting a photograph and defamatory statements about our client, a well known internet businessman, leading to embarrassing questions and inconvenience.

Our client, a leading international physician, was faced with a disgruntled former patient undertaking a web based campaign to impugn his reputation.

The President of an online marketing company was in the "cross hairs" of a former client. The former client launched a site dedicated to attacking our client's business and posted links on a major scam website to his personal site, demanding money to take it down.

A high profile lawyer had been under investigation in the late 1990s in connection with fraudulent transactions. No charges were ever brought, but the original newspaper articles (with inaccuracies) remained on the web for all the world to see, highly indexed in Google results.

Our client, a former high profile US government lawyer, launched a new web business supporting our troops in Iraq and a new “scam review site” was launched falsely complaining about his product before any product was distributed or sold.

An internationally renowned musician hired us because a website owned by lawyers representing food industry personnel had false posts about his restaurant’s practices.

A plastic surgeon was the victim of false allegations relating to a nose job and related extortion demands.

A prominent medical industry forum and website was used by an employee of a major medical company to falsely allege improprieties by our client who was a fellow employee.

A top athlete in a niche sport was the subject of false and damaging statements on the industry forum.

A syndicated radio and television personality was under attack by an obsessed blogger turned website owner who was launching new websites dedicated to attacking our client with false and malicious accusations.

A realtor selling a real estate tycoon’s condominium project was targeted and attacked online by a disgruntled purchaser.

Anatomy of the human ear, Amplitude & Frequencies

Someone recently asked me what engineering had to do with audio and video and my answer was......amplitude, spectrums & frequencies.




The human ear can respond to minute pressure variations in the air if they are in the audible frequency range, roughly 20 Hz - 20 kHz. It is capable of detecting pressure variations of less than one billionth of atmospheric pressure. The threshold of hearing corresponds to air vibrations on the order of a tenth of an atomic diameter. This incredible sensitivity is enhanced by an effective amplification of the sound signal by the outer and middle ear structures. Contributing to the wide dynamic range of human hearing are protective mechanisms that reduce the ear's response to very loud sounds. Sound intensities over this wide range are usually expressed in decibels.

Internet Law: The Ethics of Fair and Honest Reporting-When dealing with suits the best place to start is the legal department

Jester' ex-military hacker takes the distributed out of DDOS attacks

A politically-motivated hacker has apparently developed a multi-thread, thin-client denial of service attack application that effectively allows him to launch a distributed denial of service (DDOS) attack on a website from a single linux server.

Whilst single point denial of service software has been available in the hacker domain for some time, its usage has been restricted to relatively high-powered computers with T1 or better upload speeds, Infosecurity notes. According to online reports, however, a patriotic Islamic hacker — with possible military connections — and with the moniker of `Jester' on Twitter has been creating denial of service attacks on a number of sites he associates with al-Qaeda and Jihadist terrorists.

What is interesting about the attack vectors used is that the attacks are reportedly being made through the Anonine.com Swedish IP anonymiser service, which offers users high levels of anonymity in return for a modest monthly payment.

Unlike many other anonymiser services, Anonine does not impose IP traffic limitations, which appears to allow the Jester the ability to open up multiple IP sessions across a single internet connection.

According to Richard Steinon, a senior analyst with IT Harvest, the hacker has been documenting his attacks against a number of sites including www.alemarah.info, www.radicalislam.org, islamicpoint.net, www.almaghrib.org, www.as-ansar.com, www.islamicnetwork.com, www.islamicawakening.com, and www.ansarnet.info, since the start of the year.

Last Thursday, Steinon said that the Jester has posted a message that the Presidential website of Iran (www.president.ir) was going to be unavailable for the next 40 minutes, due to the country's oppressive Islamic regime.

"I approached The Jester through (direct messaging on Twitter) and provided my email address. I wanted to understand his/her motivations and intentions. These are still not completely clear but this post sums it up — the Jester Tweets; the Jester is taking on radical Islam through the web," he said in an online report.

Steinon also got a response via email from the Jester:

Hi again Richard,

Forgive me if I may sound vague on any of the following, as you can probably understand I need to protect my own identity for the moment.

I am an ex-soldier with a rather famous unit, country purposely not specified. I was involved with supporting Special Forces, I have served in (and around) Afghanistan amongst other places. Since `leaving' the governments payroll, it has occurred to me that the bad-guys are in fact starting to utilise the web more and more as a recruitment, communication, and propaganda medium.

I have been and continue to develop methods and tools to disrupt, mis-inform and obstruct this kind of terrorist activity. Kinda like taking them down from the inside, and using my weapon of choice. The method I have used to take-down the sites mentioned on twitter is rather special, it's only downfall right now is that it is obviously only temporary disruption. But I can however take down and put back their sites at will. The attack is like a DDOS attack, except without the first.

There is nothing 'distributed' about this. It is possible with very low bandwidth and a single low-spec linux machine. I am still refining the tool, but if you check right now — www.alemarah.info is in fact temporarily down, until I decide to bring it back.

According to the Jester, he is not defacing websites, a practice he denounces as mere graffiti, but wants to demonstrate a denial of service attack system he claims works over layer 7 of the internet and which runs from a linux server.

Regulation of content and freedom of speech

Last week a group of hungry, ambitious set of geeks were set out to prove themselves and their abilities. Their tasks were to scan and investigate two laptops and find evidence of spyware, corrupt files, evidence of hard drive tampering, and research on what goes into content regulation on the net, in print, in films and constitutional rights of freedom of speech.

Next three law students received stipends to research statutes on cybercrimes and what constitutes as evidence when presenting a case.

Reality-based show can evoke one to be inspired to change by the viewers that watch them. According to the TV Writers Vault reality-based shows "identify unique professions or lifestyles and that of the simplest and most successful sub-genres of reality show, is the documentary style series covering unique professions or lifestyles.

According to the TV Writers Vault, these stories serve the insatiable curiosity viewers have to gain insight into other peoples lives and jobs covered in documentary style format.

According to Randee Dawn at the LA Times, the rush to remain relevant and visible among hundreds of other competitors and today's attention-fragmented audiences, cable channels have recently begun wising up and becoming a 360-degree experience for their viewers. Some may have gone the way of edgy, original programming but, more often than not, when a cable network decides to do a makeover of its brand, it turns to reality television to make it work.

What is branding?

According to the American Marketing Association (AMA), a brand is a "name, term, sign, symbol or design, or a combination of them intended to identify the goods and services of one seller, or group of sellers and to differentiate them from those (service marks) of other sellers. To succeed, you must understand the needs and wants of your customers and prospects by integrating your brand strategies through your company at every point of public contact.' 'A strong brand is invaluable. Your brand is the source of a promise to your consumer. It's a foundational piece in your marketing communication and one you do not want to be without.' (Laura Lake, About.com Guide)

Rob Frankel, a branding expert and author in Los Angeles, says, that "it is not advertising and it's not marketing or PR. Branding happens before all of those: First you create the brand, then you raise awareness of it." (Bloomberg Business Week, 2009)

idea of branding for the show was threefold:


• branding for the B. Lynn Group
• branding for her individual client stylists
• branding for the companies/organizations serviced/supported


In this episode, Tina Greene, Executive Director of Dress For Success Essex County, experienced, shared, and motivated her Professional Women's Group (PWG) to become a part of that vision of branding for Dress For Success Essex, and the individual members of PWG. The mission of the Professional Women's group is to provide their network of "employed" women the partnership of support, practical information and inspiration to achieve self-defined success in career and life and the entire group received top notch advice from the B. Lynn Groups' well known industry stylist, Crystal Streets, on appropriate attire when meeting with clients, or going on job interviews. We also received advice about application of make-up by professional make-up, Tia Dantzler, and others.

Several days earlier, Tina, Executive Director of Dress For Success Essex County, had called me and asked me if I wanted to come down and participate in a make-over session with her Professional Women's Group (PWG) and the B. Lynn Group.

Several months prior to that invitation, I had been attending the PWG meetings, monthly. It was a great resource for me since I knew that it would be of value to me as a owner of a business.

When Tina and I, had met initially, at my school where she held her monthly PWG meetings, we brainstormed on how and where we had previously met. I had talked with Tina about my professional work, and the advocacy work performed over the past ten years, for Woman Infants and Children and how a branch of her organization (Hudson) had "dressed" me for one of the Breastfeeding Alliances' annual Breastfeeding Week activities, where I was selected to give a speech.

It was symbolic for me to represent women supporting women and my goal to go to that public speaking event armed and ready to discuss women, women's issues, and the great organizations that support them. As the audience rose to their feet, I could feel that my message was well received.

Personal Careers and Branding

When Tina and I first met, I explained that in 2007, I put my business/career on hold to make some hard decisions to:

• live with the freedom of my own thoughts
• be confident of my own value and worth
• return to school to obtain additional skills
• leave behind the people that I have outgrown




I had been supporting top executives while running my business, raising two children, and being active in my children's schools. It was time for me to move into an executive position and take my company to another level. But before doing so, I also needed to take a break while having my third child, invest more time in my family, and re-strategize, re-brand, and re-build. Competing in Citibanks' financial literacy competition seemed to me, a great way to execute some of the financial planning.

New set of Career Goals

Initially, while re-building, I submitted a business plan to the Oh! Get The Money Build Your Own Business With Oxygen. I met the contest requirements however, the winner,had a readily available, tangible product (and prototypes) to get production going right away. It was now up to OXYGEN to assist her with the branding, in which they did an awesome job.!!! I was very proud for her and all women business owners that participated in that contest. Good News!!! I have been working with one of the bankers that I met through taking the PWG financial literacy classes. PWG is an awesome support group.

While I was more of a creative person in the past, over the years, i have found myself becoming more technical and realized I needed to make Continuing Education a "life commitment". It was perfect that the professional meetings were held at my school. I knew I could fit the monthly meetings with no problems and so I enlisted in the group and have never looked back.


For me, PWG has been about supporting all kinds of working women, through knowledge of branding one own's career to yield positive results. I have invested heavily in my business and business equipment. However, I had not invested time in branding: (promoting me) and what makes me qualified and credible in what I do which is creating dynamic content on the back and front end. I have finally realized the depth of all my past experiences culminated together to perform in my new role as Chief Engineer/Producer. Now it is my responsibility to establish the who, what, when, why, and how.


On the day of the taping, I graciously accepted the invitation, packed up my things, and headed over to Newark, where a van was waiting to take all the PWG women of Dress For Success to the hotel where the show was being taped.

While taping the show, two things happened, I ran into an executive, that I had met several years earlier that worked at Bad Boy Entertainment who now works with another record label. I asked her if she remembered how she knew me and she replied yes. The events that happened after will expand several chapters of my book but, I must say, it was nice running into her there. The taping went well and the "fundraiser" brought in donations from the Derma Doctor and representatives of the Dr. Miracles hair products.

Ironically, I did not get to see that show because I was working on some final touches of editing a documentary with one of my own clients and ended up having near death experience while trying to wrap it up. Willie Sanchez: Phenomenal People who encourage and support their communities

With the encouragement of fellow colleague, Marlene, I have been afforded the opportunity and experience of a lifetime to work with an Emmy award winning television producer Willie Sanchez, whose show Images/Imagenes has covered cultural events and issues facing New Jersey’s Latino community since its premiere in 1972. Whenever I have free time aside from the kids' activities, and my work, I seize any opportunity to support Mr. Sanchez and his cause through volunteerism.



Images/Imagenes is the longest running Hispanic affairs program in the PBS system and one of the longest running television programs of its kind in the country. In conjunction with the series, NJN produces the annual Hispanic Youth Showcase, a talent show where Latino youths from New Jersey, New York and Pennsylvania compete for scholarships. The showcase is aired on the network.



On May 26, 2011 the showcase was held at the New Jersey Performing Arts Center's (NJPAC), Victoria Theatre. The performances were in categories such as dance (solo, duo and groups), instrumental music, and vocal performances. Those that write and perform published songs, instrumental music, choreograph and/or perform dances, are artistically translating tangible and intangible works of art of the "original" content creators. That evening, there was a mix of original and previously published pieces.























My reverence and deep respect for Mr. Sanchez's thirty years of dedication to these young performers stems from my appreciation and study of the arts and sciences over the years.












Prior to being a content creator (that creates intellectual works), I was a content performer of other people's intellectual works such as:



*movement

*choreography

*sound recordings for radio, television, vinyl records and cassette tapes, compact disk, etc...


Drawing on my own studies and experiences, my goal was to capture the essence of the human body through symbolism and expressionism.

The performers were in categories from tiny tots to young adults. That night the youth displayed solid examples of the hard work and dedication that goes into developing as a performer. The dancer's body (this includes voice work to strengthen the diaphragm learned in ethnic dance, and vocal training) needs strength and flexibility exercises to prevent injuries and to develop technique: Kinesiology


Dance is very much about human anatomy including the intense strengthening of the skeletal and muscular systems. A dancer's first experiences and introductions to the form includes geometrical concepts such as symmetry, physical properties such as motion, and other scientific concepts such as space, time, matter, and harmonics.




Because it is a rare phenomenon, to find this many talented, kids and consistent, dedicated, self-less parents all encompassed under one roof I was determined to, even with the lighting restrictions, to get good content.


The dancer's in this showcase were truly amazing. I was extremely impressed by the contestants, especially, the tots who had technique, placement, alignment, etc....Awesome!!!

Happy New Year- Electrical Engineering-Dynamic & Integral




Happy New Year!!!!

I have been gone for a while working on differential equations and verifying trig identities involving sine and cosine by stretching, squeezing, and translating a function until it matches the target function among other things. Electrical Engineering is a good challenge and learning from the best Electrical Engineers in the country feels great. I love these guys!!!! Secure engineers are never intimidated. Kudos!!!

So.....as an owner of an analog/digital project recording studio, NLE and interactive design studio, it is imperative that I control my experiences through client based projects and services however, from time to time I like to provide my time through offering other organizations my time. It's my way of giving back, while in school, and it also teaches my children the value of donating time to a good cause while meeting interesting people. Volunteer work is *very* rewarding.

So my recent work, as a volunteer has been very engaging. I spent the past six months working as an engineering and production intern on a Emmy Award Winning legal show and a public affairs show. Not that I needed any more professional technical experience, it was just part of the protocol that comes with being a new engineering technology graduate. While I have thousands of hours of real work practical experience as an engineer through my work with my past clients and networks, I also enjoy donating my time to organizations in need. Especially those that are having fiscal difficulties.

Although, told repeatedly that "the network" would hire me permanently, (*if I were interested in accepting and......under different financial climates), my experiences have shown me that volunteering (and also contracting-working on individual projects with clients) gives me more control over my options and are more rewarding.

It's not that I don't enjoy working in theses environments ( I have for years) it's just that when I am in these situations, It usually only takes me a couple of hours to master a position and then the work is static and redundant.

"Dynamic and Integral" are adjectives that describe my work ethic. So with the exception of an occasional issue that may need to be solved, permanent placement gets old.....real fast.

Volunteering, and work in the field with a variety of clients, is very much......dynamic and integral.


The past year was also spent working in the Information Technology group at two New Jersey Hospitals. I followed one of my professors (who was the CIO at one hospital and then relocated to the next). I respect his work and have learned a great deal from him and with broadband being the future for programming delivery, this year was well spent looking at information systems from a medical perspective.

IP is an acronym that is in my future and whether it is Internet Protocols or Intellectual Property......It is quite possible that I may go into programming for health networks....or on the backend design and trouble shoot those networks....who knows????

All I know is, that they both are acronyms that are very much "Integral and Dynamic".
